Rules of Conduct for Passengers On Board an Ural Airlines Aircraft

1. General Provisions
1.1. Air transport is an industry related to heightened danger. Protection of aircraft passengers and crew members against acts of unlawful interference into civil aviation operations as well as ensuring flight safety are the key priority in the airline’s operations, and are ensured by a wide range of measures, the execution of which is based on all air transportation parties being in compliance with the established standards, rules, and procedures.
1.2. These Rules of Conduct for Passengers On Board an Ural Airlines Aircraft (hereinafter, ‘The Rules’) have been developed and implemented with the purpose of ensuring flight safety, enhancing the level of passengers’ comfort, preventing commission of any kind of offence on board the airline’s aircraft.
1.3. The passenger’s conduct onboard the aircraft and his/her compliance with the established rules are an important component of ensuring the safety of the flight to be carried out.

2. Rights and Duties of the Passenger
2.1. The passenger has the right to:

  • require provision of services stipulated by the terms of the air carriage agreement;
  • contact crew members and require their protection in cases where his/her life, health, or personal dignity is threatened;
  • offer his/her services in medical aid to other passengers (where acceptable) and/or assistance in preparation for an emergency landing.

2.2. The Passenger on board an aircraft must:
  • comply with these Rules of Conduct On Board an Aircraft.
  • unconditionally abide by demands of the aircraft commander and recommendations of other crew members related to ensuring flight safety:
  • take the seat in the cabin of the aircraft in accordance with the boarding pass and in accordance with the instruction of the aircraft crew members, as required in order to ensure flight safety;
  • place cabin baggage and personal effects in specially assigned placed indicated by a flight attendant;
  • fasten seat belts after the Fasten Seat Belts sign is turned on, and keep them fastened until the warning sign is turned off.

2.3. The passenger is prohibited from:
  • smoking, including electronic cigarettes, during the entire flight;
  • consuming narcotic or psychotropic substances;
  • consume narcotic or psychotropic substances;
  • creating inconveniences for other passengers;
  • entering the flight deck and interfering in the actions of the flight crew;
  • distracting or obstructing crew members in the discharge of their duties, as well as giving them instructions related to flight operation;
  • using electronic devices and means of communication (including mobile telephones) during aircraft taxiing, take-off, and landing;
  • damaging (putting out of action) the airline’s property or aircraft equipment and/or carrying it away from the aircraft;
  • using emergency rescue equipment without relevant instructions from the crew;
  • leaving his/her seat in the course of aircraft taxiing, take-off, climb, descent, and landing when the Fasten Seat Belts sign is turned on;
  • committing acts of vandalism and actions humiliating other people’s honour and dignity as well as actions that may provoke other people’s aggressive actions;
  • treating other passengers and crew members irreverently and aggressively (raising one’s voice / using foul language against passengers around him/her or offend flight attendants, etc.);
  • exiting the aircraft without aircraft commander’s (crew members’) permission;
  • carrying weapons or imitation thereof;
  • committing other inadequate actions that may create a threat to health and life of passengers or impact the safety of the flight carried out;
  • taking pictures and making video of aircraft crew members and other passengers without their consent. Pursuant to Article 152.1 of the Civil Code of the Russian Federation, “… use of a citizen’s image (including their photograph, as well as video) is permitted only with the consent of this citizen”.

A passenger committing the actions stated above, likewise failing to abide by the crew members’ requirements to comply with the standards and rules for ensuring flight safety and aviation security shall be acknowledged to be infringing these Rules.

For the infringement of the established Rules during the flight operation on the Russian Federation domestic air routes, the passenger shall be held liable in accordance with the requirements of the existing Russian law; during flights on international air routes the same shall happen in accordance with the requirements of international air law (international conventions) and the law of the country of destination or the country of intermediate landing, independent of the country of aircraft registration or operation.

3. Passengers’ liability for violation of the Rules of Conduct On Board an Aircraft
3.1. To ensure safety of aircraft passengers and crew members, pursuant to Article 107 of the Russian Federation Aviation Code, the airline (carrier) has the right to unilaterally terminate the passenger air carriage agreement in cases where:

  • the health of the passenger of the aircraft requires special conditions of carriage or threatens the safety of the passenger him-/herself or other persons, which shall be confirmed by medical documents, as well as makes disorder and creates unavoidable inconveniences for other persons;
  • there is violation of the Rules of Conduct On Board an Aircraft by the aircraft passenger, endangering security of aircraft flight or life or health of other persons, as well as non-compliance by the passenger with instructions of the aircraft commander given in accordance with Article 58 of the Russian Federation Aviation Code;
  • there are articles or substances prohibited for air carriage in the things belonging to the passenger as well as in the baggage or cargo.

3.2. In accordance with the provisions of Article 58 of the Russian Federation Aviation Code, the aircraft commander has the right to:
  • give instructions to any person on board for flight safety ensuring reasons and to require compliance with such instructions;
  • take all necessary measures, including enforcement measures, against persons creating an immediate threat to the safety of the flight of the aircraft and refusing to comply with the instructions of the captain of the aircraft;
  • upon arrival of a plane at the nearest aerodrome, remove such persons from the aircraft, and in case their acts are of a criminal nature hand them over to law-enforcement authorities.

3.3. In accordance with the Convention on Offences and Certain Other Acts Committed On Board Aircraft (Tokyo, 1963), and the current practice of application thereof in international civil aviation, any crew member has the right to:
  • take reasonable preventive measures without the aircraft commander’s authorization if there are reasonable grounds to believe that such action is immediately necessary to protect the safety of the aircraft or persons and property therein;
  • stop serving alcoholic beverages to passengers who are in a state of alcoholic or any other intoxication;
  • remove from passengers for the time of the flight (with subsequent return after completion of the flight) alcoholic beverages that belong to them, including those purchased in duty-free stores on board the aircraft.
3.4. In accordance with the Convention "On offences and certain other acts committed on Board aircraft" (Tokyo, 1963) and established in international civil aviation practice to its application to any member of the crew shall be entitled to:
  • to take reasonable preventive measures without authorization of the aircraft commander if there are reasonable grounds to believe that such measures should be taken immediately to ensure the safety of the aircraft or the persons and property;
  • stop serving alcoholic beverages to passengers in a state like intoxication, and other intoxicating substances;
  • to withdraw from the passengers on the flight (with subsequent return after the flight) that belongs to them alcoholic beverages, including those purchased in duty free shops on Board.
In the event of termination at the initiative of the airline (carrier) of the contract of carriage as a result of violation by the passenger of subparagraph "2" of paragraph 3.2. with this regulation, the amount paid for air carriage, the passenger will not be refunded.
The rights granted to the commander (crew) of the aircraft specified in clauses 3.2 - 3.4 are implemented by:

  • the delivery of the passenger "Warning on the need to end violations of the Rules of conduct on Board aircraft" (Annex No. 1), if an oral request of the commander of an aircraft (crew members) was not complied with;
  • compile the "Act of violation of the Rules of conduct on Board aircraft" (Annex 2), if the aircraft commander made a decision to remove a passenger from the aircraft and transfer it to law enforcement. One copy of the act herewith transmitted to law enforcement, the second is applied to the assignment for the flight, and the third is given to the passenger.
